When rules are unclear, capital waits. Boards hesitate. Teams stall. Regulation, when designed well, removes that drag. It creates predictability. And predictability is what unlocks investment, hiring and real innovation.
Why Predictability Fuels Innovation
This isn’t ideology, it’s evidence. Decades of research show that clear, stable rules lower perceived risk and increase willingness to invest. In environmental policy, the Porter hypothesis framed it: good rules spur better products and processes.
In fintech, regulatory sandboxes turned principle into practice. The UK’s sandbox, the first of its kind, is associated with a 15% increase in capital raised and a 50% higher probability of raising capital for participating firms — alongside higher survival and patenting rates [1]. Hardly a case of regulation slowing things down.
The Borderless Dilemma — and the Standards Moat
Digital markets are borderless. Regional regulation can look like a handicap. But when the rules are reasonable and consistent, they create a standards moat: a trust and compliance baseline that competitors must meet to participate.
This is sometimes called the Brussels Effect. EU rules (think GDPR) often become the de-facto global standard because it’s cheaper (and reputationally safer) to build once to the strictest bar and ship globally [2]. Standards reshape products and buyer expectations, a moat that is often more durable than tariff walls. For AI, the EU is attempting exactly this with the AI Act.
What the EU AI Act Actually Does

The AI Act is a binding regulation with phased application dates, not a “nice-to-have.” It uses a risk-based framework:
- Unacceptable risk (e.g., social scoring): prohibited.
- High-risk (e.g., healthcare, critical infrastructure): strict obligations (risk management, data quality, human oversight, documentation).
- Limited risk (e.g., chatbots, synthetic media): transparency duties (tell people they’re interacting with AI; label deepfakes).
- Minimal/no risk (e.g., spam filters, games): no new obligations [3].
Rhetorical question: do any of these sound unreasonable, or unlike what we’d expect from an ethical, responsiblebusiness? Flip it again: would you argue for social scoring, opaque high-risk systems, or unlabeled deepfakes? If so, make the case. Otherwise, the Act is largely codifying common-sense boundaries.
Timing matters: the Act entered into force on 1 August 2024, with prohibitions and AI-literacy rules applying from 2 February 2025, GPAI model obligations from 2 August 2025, and most other provisions applying by 2 August 2026[4]. Translation: this is not tomorrow’s problem, it’s already here.
Who’s Aligned — and Who Isn’t (and why that matters)
Companies don’t “sign the Act,” but many have pledged early alignment through the EU AI Pact and the EU AI Code of Practice.
- Google and Microsoft : backing the EU’s voluntary instruments.
- Meta: rejected the Code of Practice, arguing scope and legal overreach.
- xAI: says it will sign only the Safety & Security chapter, criticising transparency and copyright provisions.
Signals matter. When firms associated with trust and scale commit, and those with ongoing ethics/transparency pushback resist or partially opt-in, it tells the market where long-term risk is likely to sit [5].
Proof that Smart Regulation Can Accelerate Markets
If you think “supportive regulation” is an oxymoron, look at the UK’s fintech story. A credible regulator (FCA), an innovation-friendly sandbox, and a clear narrative helped London become a global fintech hub. The sandbox’s impact on funding is measurable (see above), and the policy direction is well documented in the Kalifa Review [6].
Lesson for AI: pragmatic oversight + early clarity = capital confidence.

- Start-ups / scale-ups Treat the AI Act like an early-stage product constraint, the kind that forces better design choices and prevents expensive pivots later.
- Legacy enterprises Predictability is a gift, not a punishment. The phased timeline gives you a window to modernise: inventory your AI, map risk, and bring high-risk systems to compliance. The alternative is reactive retrofits in 2026–27: slower, pricier, and reputationally riskier.

The problem isn’t that we regulate too much. It’s that we regulate too late. By the time rules arrive, damage is done, investments wasted, and trust broken.
